1. Agreement
By accessing or using Alpha, you agree to these Terms of Service and the Privacy Policy. If you use Alpha for a business or organization, you represent that you have authority to accept these terms for that entity. You must be at least 18 years old and legally able to enter an agreement.
2. Accounts and authorized access
You are responsible for accurate account information, protecting login credentials, and activity performed through your account. Access is limited by assigned roles and websites. You may not share access in a way that defeats Alpha’s permissions or account limits. Notify us promptly if you believe an account has been compromised.
3. Alpha services
Alpha may provide website management, structured editing, publishing, forms, analytics, CRM, relationship activity, email tools, AI-assisted drafting, booking, calendar connections, and related services. Available features may depend on the customer’s plan, configuration, permissions, or connected services.
We may improve, update, limit, or discontinue parts of Alpha. We will use reasonable efforts to avoid unnecessarily disrupting paid services, but we do not promise that every feature will remain unchanged.
4. Customer content and information
You retain ownership of content and information you lawfully provide to Alpha. You grant Dee Bright and Associates a limited right to host, process, reproduce, modify, and transmit that material only as needed to provide, secure, support, and improve the service or follow your authorized instructions.
You are responsible for having the rights and notices needed to collect and use information through your website, forms, CRM, email, analytics, and booking experiences. You may not upload or use content that violates law, another person’s rights, or these terms.
5. Booking and third-party services
Alpha may connect with services such as Google Calendar, Supabase, email providers, AI providers, and website-hosting services. Your use of those services may also be governed by their terms and policies.
Alpha Booking helps calculate availability and create, reschedule, or cancel calendar events. You remain responsible for your availability settings, meeting information, calendar accuracy, communications, and delivery of the scheduled service. A booking confirmation is not a guarantee that a meeting, sale, or business result will occur.
6. AI-assisted features
AI-generated drafts, recommendations, and interpretations may be incomplete or inaccurate. Review them before approval, publication, or use. Alpha’s approval safeguards do not replace your responsibility for business, legal, financial, or professional decisions.
7. Acceptable use
You may not use Alpha to break the law; infringe rights; send spam or harmful content; mislead, harass, or exploit people; distribute malware; probe or bypass security; access another customer’s information; overload the service; or reverse engineer protected parts of the platform except where law expressly permits it.
8. Fees and suspension
Pricing, billing periods, included capacity, and renewal terms are stated in the applicable order, proposal, plan, or service agreement. Unpaid amounts, misuse, security risks, legal requirements, or material violations may result in limits or suspension. Ending service does not erase payment obligations already incurred.
9. Disclaimers and liability
To the extent permitted by law, Alpha is provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, specific business results, lead volume, revenue, search ranking, delivery by third-party providers, or continued availability of third-party integrations.
To the extent permitted by law, Dee Bright and Associates will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from Alpha. Any aggregate liability relating to the service will not exceed the amount paid for the affected service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply.
10. Indemnity and termination
You agree to defend and indemnify Dee Bright and Associates against third-party claims arising from your content, your use of Alpha, your violation of these terms, or your infringement of another person’s rights. Either party may end the service as allowed by the applicable plan or agreement. Terms that reasonably should survive termination will continue to apply.
11. Governing law and changes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. We may update these terms as Alpha changes. Continued use after updated terms take effect constitutes acceptance where permitted by law.
